1. OFFER CONTENT AND GENERAL TERMS
VIR TOURS d.o.o., Ive Senjanina 12A, 23000 Zadar, Croatia (hereinafter referred to as Apartment) provides and sells accommodation services based on published information, description, terms, and valid price list, according to confirmed reservation/contract, on its behalf and for its account. An agency or tour operator may appear as the service buyer for the end-user, and the provisions of the General Terms also apply to them as intermediaries. By sending a reservation inquiry, you confirm your agreement with the General Terms of the Apartment and it becomes a legal obligation. When providing services at the Apartment, rules prescribed by the house rules, catering customs, and in accordance with the applicable positive legal regulations of the Republic of Croatia are applied.
2. ACCOMMODATION RESERVATION AND PAYMENT
After sending an initial accommodation inquiry, you are considered a prospective user of accommodation services. All records are kept under the name of the person who submitted the inquiry (if a natural person, then the first name and last name, and if a legal person, then the full company name with all details). By filling out and sending the reservation request, the reservation holder confirms that he/she is authorized to make the reservation on behalf of all persons listed in the inquiry, and that others also agree to it, and that they are also bound by the reservation terms. When making a reservation, the reservation holder is obliged to provide all the information required by the reservation process. An accommodation reservation inquiry is considered an open inquiry forwarded to the Apartment by any means of communication in written form (letter, email, fax, etc.). Based on the open inquiry, the Apartment will provide the reservation holder in writing with the amount of the cost of the reserved service and reservation conditions. Accommodation reservation for the appropriate period is valid only if the reservation holder has fulfilled all the conditions specified in the reservation and after receiving the written confirmation of the reservation from the Apartment. If the reservation holder fails to meet the required conditions within the agreed deadline, the reservation is considered an expired option. By fulfilling the agreed conditions specified in the reservation, you accept the General Terms of the Apartment and it represents a formal legal conclusion of the contract. In a formal legal sense, the reservation holder always has the responsibility and cannot transfer his/her responsibility to the persons for whom the reservation was made. Reservations are not accepted from persons under the age of 18. In such cases, we reserve the right to reject processing reservation inquiries without specifying any reasons. The Apartment reserves the right to refuse, cancel, or modify a reservation if there is an abuse of the reservation system or if it was made by the user's mistake. It is the duty of the Apartment to take care of providing services and to care about the rights and interests of guests in accordance with good practices in tourism. The Apartment will fulfill all obligations in full and in its standards, in a timely manner, in good faith, and with the care of a conscientious entrepreneur, in accordance with the rules of the profession, except in extraordinary circumstances. The Apartment undertakes to respect the privacy of all its users and will not disclose their data without their consent. The Apartment collects only necessary user data needed to execute the reservation. All user data is strictly kept and is only available to employees who need that data to perform their job. All Apartment employees and business partners are responsible for respecting the principles of privacy protection.
3. ACCOMMODATION AT THE APARTMENT
The arrangement of accommodation units is determined by the reception. If the guest has not expressly agreed to a room of specific characteristics, he/she will accept the officially registered accommodation unit assigned. Accommodation in the room is not possible before the time indicated on the descriptive page of the accommodation unit on the day of the start of service use, and it must be vacated by the time indicated on the descriptive page of the accommodation unit on the day of the end of service use.
4. PRICES
The price of accommodation includes the basic service as described in the valid accommodation price list when the reservation is confirmed. Additional services are those services that are not included in the price of accommodation (additional services provided with prior notice) and are, therefore, paid for separately by the guest. These services should be requested when making a reservation at the Apartment reception. The Apartment reserves the right to change prices if there is a change in exchange rates compared to the day of price publication. The Apartment may inform the guest in writing or orally about the price change.
5. CHANGES ON YOUR PART
If you are unable to travel, you have the right to transfer your reservation to third parties or to another date. In this situation, you need to inform the Apartment in writing at least 2 days before the arrival. Until the Apartment receives written consent from another person to take over the reservation on your behalf, you are responsible for the total amount of ordered services.
6. OTHER CHANGES
If you want to make changes to a confirmed reservation, you must notify the Apartment in writing as soon as possible. The Apartment will try to accommodate your wishes, but cannot guarantee in advance that it will be possible.
7. CANCELLATION OF RESERVATIONS
If you want to cancel a reservation, you can do so by email or phone. The reservation cancellation is only accepted from the reservation holder or a person legally authorized to do so on his/her behalf. For reservation cancellation, the Apartment is entitled to compensation according to the cancellation price list, unless otherwise defined by the reservation. Depending on the date of receipt of the reservation cancellation notice, the Apartment applies the following cancellation price list: CANCELLATION TERMS FOR INDIVIDUAL RESERVATIONS
8. CHANGES AND CANCELLATION BY THE APARTMENT
The Apartment reserves the right to change a reservation or the way services are provided at any time if circumstances occur that are beyond our control, cannot be predicted, avoided, or delayed. The confirmed accommodation unit can be replaced with an accommodation unit of the same or higher category while retaining the same price that was valid at the time of reservation confirmation and timely informing the guest of the change. In cases where it is not possible to find replacement accommodation, and the reservation has been paid in advance, the Apartment reserves the right to cancel the reservation and refund the entire paid amount.
9. COMPLAINTS
In accordance with Article 10, paragraph 1, item 10 of the Hospitality Business Act (NN 85/2015), guests dissatisfied with the purchased product or provided service can express their complaint in writing at the reception of the Apartment, where the Apartment will promptly confirm receipt of the complaint in writing. A written response will be provided within 15 days from the date of receiving the complaint.
10. ARRIVAL AND DEPARTURE FROM THE APARTMENTS
The house rules of the Apartment are established and are available in each Apartment room.
11. GUEST'S OBLIGATIONS AND RESPONSIBILITIES
As a guest, you are required to possess valid travel documents, comply with customs and other regulations of the Republic of Croatia, and adhere to the house rules and instructions of the Apartment staff. The guest is responsible for the care of the property, as well as all furniture, decorations, equipment, and the environment, in the same condition and state as they were at the beginning of the service usage. For any kind of damage, the guest is responsible and must reimburse the cost to the Apartment.
12. ADDITIONAL SERVICES
Payment for additional services is by agreement or according to the valid price list. The Apartment does not take responsibility for services provided by other service providers. If the guest wishes to use additional services, they need to be announced in advance at the reception of the Apartment.
13. SAFETY AND VALUABLES
The Apartment is not responsible for damaged, destroyed, or lost luggage, nor for its theft. Any valuables left in the Apartment’s room are at the guest's own risk. The Apartment is not liable for the loss of items if they were not reported and stored in the room safes. Loss or theft should be reported to the Apartment reception and the local police station.
14. PETS
Bringing pets is not allowed.
15. LIABILITY OF THE APARTMENT
The Apartment is not liable in case of death, illness, or injury to anyone in the Apartment, unless the harmful event was caused by the Apartment or its staff's gross negligence. The Apartment is not responsible for loss, interruption, or delay due to any cause beyond our control, including but not limited to force majeure (explosions, bad weather, fire or accidents, war or threat of war, civil unrest, restrictions, local laws, or any government or local authority measures, strikes, entry bans, or other industrial actions, interruptions, etc.). In cases of release from the obligation to perform, the liability of the Apartment is limited only to the refund of the amount paid related to the reservation. The Apartment is not responsible for complaints arising from the malfunction of mechanical and other equipment in accommodation; for example, heat pumps, boilers, etc., nor for the interruption of communal services (electricity, water, gas, etc.). The Apartment is not responsible for noise or disturbances coming from beyond the premises of the Apartment or beyond the control of the staff. The Apartment is not responsible for events beyond our control, such as bad weather, delays by other carriers, equipment failures, injuries caused by improper use of equipment and failure to follow instructions, as well as intentional damage caused by service users of the Apartment.
16. RESIDENCE TAX
Residence tax is calculated according to applicable legal regulations, and the guest is obliged to pay it simultaneously with the payment for the accommodation service. Residence tax is included in the accommodation price.
17. CATEGORIZATION AND DESCRIPTION OF THE FACILITY
The offered accommodation and other capacities are described according to the official categorization of the Republic of Croatia. The Apartment is not responsible for oral or written information that does not correspond to the description of services and the facility itself in the published programs and is obtained from a third party. The Apartment is not liable in case of incorrect data provided by business partners.
18. NOTE
By confirming the accommodation reservation in writing, the guest or group of guests, whether a natural or legal person, who made the reservation, fully accepts these General Terms. The General Terms are available on the website of the Apartment.
19. CURRENCY
All payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in other currency into EUR according to the current exchange rate of the Croatian National bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
20. ONLINE PAYMENT
VIR TOURS d.o.o. uses Monri WSPay for online payments. Monri WSPay is a secure system for online payments, providing real-time payment processing, credit and debit card payments, and other payment methods. Monri WSPay ensures secure entry and transfer of card data for both
the customer and the merchant, as confirmed by the PCI DSS certificate held by Monri WSPay. Monri WSPay uses a 256-bit SSL certificate and TLS 1.2 cryptographic protocol as the highest levels of protection for data entry and transfer.
